These Terms and Conditions (“Terms”) govern your access to and use of www.senshin2148.com (the “Website”) and the services provided through The Infinity Project (the “Service”). By using the Website or participating in the Service, you agree to these Terms.

1. Who we are & how to contact us

1.1 These Terms govern your use of the Website and Service operated by BARR2148 LIMITED (Company No. 15182433), registered office: 20 Ashfield Road, Leicester, England, LE2 1LA (“we”, “us”, “our”).

2. What we do

2.1 The Infinity Project is a digital memory preservation service. Participants may submit content such as name, image, and ideas (together, “Submissions”) to be preserved within an archive (the “Archive”).
2.2 The Service does not provide participant-to-participant messaging, contact, or communication features. Participants cannot talk to each other through the Website.
2.3 No account creation is required to participate.

3. Archive options: Public Archive and Private Archive

3.1 When you participate, you choose one of the following:

• Public Archive: your details and Submissions are publicly visible (viewable by anyone).

• Private Archive: only your name and country are displayed publicly. Your other Submissions are not publicly displayed.

3.2 If you select the Public Archive, you understand that your content may be copied, shared, indexed by search engines, or re-posted by third parties outside our control. We cannot control what others do with information once it is public.

4. Eligibility

4.1 You must be at least 18 years old and legally capable of entering a binding contract.
4.2 You confirm that information you provide is accurate to the best of your knowledge.

5. Your Submissions and content rules

5.1 You are solely responsible for the Submissions you provide and anything you choose to include.
5.2 You confirm you have all necessary rights to submit and authorise our use of your Submissions (including rights in images and any third-party materials).
5.3 You must not submit content that:

• is unlawful, defamatory, harassing, hateful, discriminatory, or otherwise harmful,

• is misleading, deceptive, or fraudulent,

• infringes intellectual property rights or privacy rights,

• includes personal data of others without their clear permission,

• contains malware, viruses, or disruptive code,

• includes highly sensitive information you do not want stored (for example, home address, identity numbers, financial data).

6. Licence you grant to us

6.1 You keep ownership of your Submissions.
6.2 By participating, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, and display your Submissions only as necessary to operate the Service, and only according to your selected archive type (Public Archive or Private Archive).

7. Moderation and takedown

7.1 We may refuse, restrict, remove, or disable access to any Submission where we reasonably believe it:

• breaches these Terms,

• breaches applicable law,

• creates security, safety, or operational risk,

• or is technically incompatible with the Service.

7.2 If we remove or restrict content due to your breach of these Terms, no refund is due (where fees apply).

8. Capsules and user threshold

8.1 The Service is designed to create “capsules” (compiled preservation outputs) once the Service reaches between 100,000 and 1,000,000 users.
8.2 Until that threshold is reached, your participation may still result in your Archive entry being created and displayed according to your chosen archive type.
8.3 We do not guarantee that the threshold will be reached by any specific date (or at all).

9. Fees, performance, and digital delivery

9.1 If fees apply, they will be shown clearly at the point of purchase/participation.
9.2 The core digital service is performed when your Archive entry is created and made available according to your archive selection (Public or Private).
9.3 If you request immediate performance (for example, immediate creation/publication of your entry), you acknowledge that digital supply begins immediately.

10. No refunds (digital product)

10.1 The Service is a digital product. All purchases are final and non-refundable, except where required by applicable law.
10.2 If a payment error occurs (for example, duplicate payment due to a technical issue), we may correct it, including issuing a refund where appropriate.

11. Removal requests (complete deletion)

11.1 You can request complete removal of your profile (Public or Private) by emailing senshin@barr2148.com.
11.2 To protect participants, we may request reasonable information to verify the removal request is genuine.
11.3 Removal means we will delete your profile from the Service and stop displaying it. If your content has been copied by third parties (especially in the Public Archive), we cannot guarantee removal from places outside our control.

12. Privacy and no data sharing

12.1 We process personal data in accordance with our Privacy Policy (published on the Website).
12.2 No data sharing: we do not sell or share participant Submissions with third parties for marketing or advertising.
12.3 The Service does not include participant messaging or social features.

13. Availability, changes, and third-party services

13.1 We do not guarantee uninterrupted or error-free access to the Website or Service.
13.2 We may update, change, suspend, or discontinue parts of the Service for operational, legal, or security reasons.
13.3 The Website may rely on third-party services (for example, hosting, security, and payment processors). Third-party links (if any) are not under our control and we are not responsible for their content or policies.

14. Our resources: no copying or distribution

14.1 All resources created by us, including but not limited to the Website design, layout, text, graphics, branding, archive presentation format, templates, and any Service materials (“Our Resources”), are owned by or licensed to us.
14.2 You must not copy, reproduce, distribute, republish, upload, transmit, modify, create derivative works from, or commercially exploit Our Resources in whole or in part without our prior written consent.

15. Limitation of liability

15.1 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be limited.
15.2 Subject to 15.1, we are not liable for indirect or consequential loss, loss of profits, loss of business, loss of goodwill, or loss of data arising from your use of the Service.
15.3 To the extent permitted by law, our total aggregate liability in any 12-month period will not exceed the total fees you paid to us in that period.

16. Indemnity

You agree to indemnify and hold us harmless from claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your Submissions, your breach of these Terms, or your violation of law or third-party rights.

17. Branding, trademarks, and rights

17.2 You must not use our trademarks, resources (of any kind) or branding without prior written permission.

18. Complaints and contact

If you have questions, complaints, or requests (including removal requests), contact senshin@barr2148.com and we will respond within a reasonable timeframe.

19. Changes to these Terms

We may update these Terms from time to time. Changes take effect upon posting on www.senshin2148.com. Continued use of the Website or Service constitutes acceptance of the updated Terms.

20. Severance

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in force.

21. Governing law and jurisdiction

These Terms and any non-contractual obligations are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, without prejudice to mandatory consumer rights.
